Virtual staging and MLS rules: what to disclose, and how.

Short answer: virtual staging is allowed everywhere we know of, as long as it is disclosed and nothing structural is changed. The exact format is set by your own MLS board, so read its rules before you publish. This page is general information, not legal advice.

The safe default, in three moves

  1. Paste a disclosure in the remarks: “Photo has been virtually staged. Furnishings are not included.”
  2. Upload the unaltered original directly before or after the staged photo.
  3. Only add furniture and décor — never repaint, refloor, remove fixtures or hide defects.

Is virtual staging legal on the MLS?

Yes. No national rule forbids it. What is forbidden is a misleading picture: NAR's Code of Ethics (Article 12, Standard of Practice 12-10) requires REALTORS® to present a true picture in their advertising. Staging that adds furniture, disclosed, is a true picture of the room. Staging that hides a defect or changes the property is not.

What must the disclosure say?

Most boards accept a plain sentence in the public remarks or the photo caption, such as: “Photo has been virtually staged. Furnishings are not included.” Some boards also want a label on the image itself, such as “Digitally Altered” or “Virtually Staged”.

Do I have to upload the original photo too?

Increasingly, yes. ARMLS (Arizona) requires the unaltered original directly before or after the staged image. In California, AB 723 (in force since January 1, 2026) requires a disclosure on digitally altered listing images and access to the unaltered version. Keeping the original next to the staged file satisfies both shapes of rule.

What may I never change?

Anything the buyer is buying: walls and wall colour, flooring, windows and the view through them, fixtures such as radiators, built-ins, ceilings, and any defect. Adding movable furniture and décor is staging; changing the property is misrepresentation.

Who is responsible if a staged photo is misleading?

The listing agent. Tools do not carry the liability, which is why NowFurnished rejects any render that alters the structure and hands you the disclosure line and the original with every download.

Staging that is built to be disclosed.

Every NowFurnished render is checked against your photo so the structure never moves, and every download comes with the disclosure line and your original for the upload pair.
